Welcome to Maple Pictures Corporation “The Create Your Own Spirit Character” online contest (“Contest”). By entering this Contest, you acknowledge that you have read, understood and accept the terms and conditions below, as well as the mycineplex Terms of Membership.

Sponsor: Maple Pictures Corporation is the sponsor (“Sponsor”) of this Contest and Cineplex Entertainment LP is responsible for conducting and administering this Contest (“Administrator”).

  1. How to Enter: No purchase necessary. The Create Your Own Spirit Character Contest (the “Contest”) begins at 12:01 PM E.T. on Monday December 1st, 2008 and ends at 5:00 PM E.T. on Monday January 5th, 2009 (“Contest Period”). To enter the Contest, entrants must meet the eligibility conditions set out below in Rule 4, and either be an existing subscriber to mycineplex or they must become a member to mycineplex during the Contest Period and maintain their membership for the duration of the Contest Period. There are two methods of entry for this Contest:

To qualify for the Secondary Prize, simply go to Contest link found on cineplex.com and fill out the entry form and submit it. All fields must be completed unless indicated as optional. The odds of winning will depend on the total number of eligible entries received during the Contest Period. Proof of submission does not constitute proof of receipt. Only one (1) entry per natural person and per email address allowed during the Contest Period. Any automated, programmed, scripted, robotic or similar entry mechanisms are prohibited. In the event the Sponsor discovers attempts at multiple entries by one person using the same or multiple email addresses, each entry will be void and the entrant disqualified at the sole discretion of Sponsor.

To qualify for the Grand Prize, new or existing mycineplex members must complete or update their registration by creating a screen name. Once you have a screen name, go to mycineplex.com and click on the download link found under Contest heading. Use the assets provided to create a picture related to ‘The Spirit’ (your “Entry”). Entries must meet the following conditions:

Once the Entry is complete, simply go to my.cineplex.com/photos/, upload the Entry ensuring you select “The Spirit Creation” from the dropdown list menu, name it, describe it and save it. The odds of winning will depend on the total number of eligible entries received during the Contest Period, and the skill of the entrant in creating an Entry to satisfy the Judging Criteria set out in Rule 3 below. Only one (1) entry per natural person and per email address allowed during the Contest Period. Proof of submission does not constitute proof of receipt. In the event the Sponsor discovers attempts at multiple entries by one person using the same or multiple email addresses, each entry will be void and the entrant disqualified at the sole discretion of Sponsor. By submitting an Entry, entrants grant to Sponsor and Administrator a royalty-free, perpetual, non-exclusive, irrevocable, unrestricted, worldwide license to: (a) use, reproduce, store, adapt, translate, modify, make derivative works from, transmit, distribute, publicly perform or display such Entry for any purpose via all forms of media now known or hereafter devised; and (b) to transfer or sublicense to third parties the unrestricted right to exercise any of the foregoing rights.

  1. Prizes:

Grand Prize: There is a total of (1) one Grand Prize available to be won. The Grand Prize is an autographed The Spirit storyboard sketch by Frank Miller. Approximate Retail value of the Grand prize is $500.00 CDN.

Secondary Prize: There are a total of (10) ten SPIRIT Prize Packs available to be won. Each prize pack will consist of: a limited edition T-shirt, limited edition Spirit aluminum water bottle, and the Random House official movie companion book. Approximate Retail value of the Secondary prize is $75.00 CDN each. General Prize Conditions: Prizes must be accepted as awarded, are not transferable, non-refundable, and cannot be substituted or exchanged for cash, or any other prizes. The Sponsor reserves the right, at its absolute discretion, to make substitutions of equivalent kind or monetary value in the event of unavailability of all or part of any of a prize for any reason whatsoever. The Grand Prize winner will be required to sign a declaration, release and license form before being awarded the Grand Prize. Prizes will only be delivered to verified winners.

  1. Selecting winners:

Secondary Prize Draw: The potential ten (10) Secondary Prize winners will be selected in a random drawing to be held on or about Thursday January 8th, 2009 at approximately 12:00 PM E.T. in Toronto. The Sponsor will attempt to contact the selected potential ten (10) Secondary Prize winners by email and/or telephone up to 3 times during business hours between Friday January 9th, 2009 and Tuesday January 13th , 2009, after which, if unsuccessful the Sponsor shall discard the selected entries and randomly select alternate winners. This process shall continue until the Secondary Prizes have been awarded. Before being declared the winner of a Secondary Prize, the selected entrant must first correctly answer, without assistance of any kind (whether mechanical or otherwise) a time-limited mathematical skill-testing question to be administered at a mutually convenient time by telephone. If the selected entrant fails to answer the question correctly, the prize will be forfeited and an alternate potential winner will be selected.

Grand Prize Judging: Deborah Del Prete (the “Contest Judge”), the producer of the film will judge the Entries that have been uploaded for ”The Create Your Own Spirit Character” contest and select one potential Grand Prize winner by Friday January 16, 2009 by 12:01am PST, in Los Angeles. Judging will be based on the best examples of the Spirit tone and costuming/makeup. While it is not mandatory to use the assets provided for the final ‘character’ submitted, the final entry must have some relevancy to The Spirit motion picture. Refer to ‘User submissions‘ in the Terms of Membership. [Link to: http://www.cineplex.com/Global/TermsofMembership.aspx#12] In the event that the named Contest Judge should be unavailable to judge the Contest for any reason, the Sponsor shall select an alternate Contest Judge at its sole discretion. The Sponsor will attempt to contact the selected potential Grand Prize winner by telephone up to 3 times during business hours between Monday January 19th and Wednesday January 21st, 2009, after which, if unsuccessful the Sponsor shall discard the selected entry and selected the Entry with the second highest score. Before being declared the winner of the Grand Prize, the selected entrant must first correctly answer, without assistance of any kind (whether mechanical or otherwise) a time-limited mathematical skill-testing question to be administered at a mutually convenient time by telephone. If the selected entrant fails to answer the question correctly, the prize will be forfeited and an alternate potential winner will be selected.   1. Eligibility: Contest is open to legal residents of Canada who are over the age of majority in the province [or territory] in which they reside as of Monday, December 1st, 2008. Contest is not open to: (a) employees of the Sponsor, the Administrator, or any of their respective parent, subsidiary or affiliated companies, licensees, advertising and promotional agencies (“Related Parties”) or other suppliers of goods or services related to the Contest; or (b) members of the immediate family (defined as parents, siblings, children or spouses, regardless of where they reside) of such employees; or (c) those with whom such employees are domiciled (whether related or not). Void where prohibited.
  2. General Rules: The Sponsor shall not be liable for lost, late, incomplete, garbled, misdirected, not received, stolen, mutilated, or illegible entries. By entering this Contest, entrants accept and agree to be bound by these Official Contest Rules and the decisions of the Sponsor, the Contest Judge and independent judging organization, if any, which are final, binding and conclusive on all matters relating to this Contest. All Entries become the property of the Sponsor and none will be returned. No correspondence will be entered into except with selected entrants who will be notified by telephone. The Sponsors reserve the right to disqualify all entrants who fail to comply with these Official Contest Rules or who make any misrepresentation relating to the Contest, drawing and redemption of the prizes. This Contest is subject to all applicable Federal, Provincial and Municipal legislation. The Sponsor shall not be responsible for any failure of the website during the Contest Period or for any problems or technical malfunction of a telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any e-mail, on-line, or Internet entry to be received by the Sponsor. In addition, the Sponsor shall not be responsible due to technical problems, traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entrant's or any other person's computer or property related to or resulting from playing, downloading, or uploading any material in the Contest. The Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux (the “Régie”) in the Province of Québec, to terminate or amend this Contest at any time and in any way, without prior notice. Without limiting the foregoing, if, for any reason, the Contest is not capable of running as originally planned, such as tampering, a virus, bug or any other cause beyond the reasonable control of Sponsor corrupts the security or proper administration of the Contest. In such an event, Sponsor reserves the right, with the consent of the Régie, to cancel the Contest and conduct the random draw from all previously received eligible entries received. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. In the event of a dispute, online entries will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. A selected entrant may be required to provide proof that he/she is the authorized account holder of the email address associated with the selected entry name change. The sole determinant of the time for the purposes of a valid online entry in this Contest will be the contest server machine(s).   3. Privacy:
    By entering this Contest, entrants consent to the use of their personal information by Sponsor, Administrator and their respective authorized agents for the purpose of administering the Contest and fulfilling prizes. At Cineplex, we are committed to respecting your desire for privacy. Any personal information that we gather will be handled in strict accordance with our privacy policies and all applicable privacy legislation. Cineplex will not sell your personal information collected for this contest to any third parties. Any personal information collected for this contest shall be used by Cineplex as is disclosed herein. Please note that by submitting personal information to Cineplex, you consent to our use as described herein http://www.cineplex.com/Global/PrivacyPolicy.aspx. When you enter this Contest, you may choose to sign up for Club Maple, the Sponsor's e-mail based newsletter. If you do request to receive future communications from Sponsor, your personal information will be used by Sponsor solely for this purpose, and will not be used or disclosed for any other reason unless required by law. By accepting a prize, winners consent to the use of their name, address (city/province), photograph or other image, voice and/or statements by Sponsor, Administrator and their respective authorized agents for the purposes of advertising and promotion in any media without further notice or compensation.
  4. No Liability:
    Sponsor shall not be responsible in any way for the use of, or bear any liability whatsoever in any way attributable to, any prize awarded in this Contest or the events forming part of this Contest.
  5. Quebec:
    For Quebec residents, any litigation respecting the conduct or organization of this contest may be submitted to the Régie des alcools, des courses et des jeux du Québec for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
